1. INTRODUCTION
SteadySelf Pty Ltd ("SteadySelf", "we", "our" or "us") operates a voice-activated artificial intelligence (AI) wellbeing protocol designed to help people manage moments of stress or panic (the "Service"). The Service offers self-reflection prompts, mindfulness advice, and general informational content delivered through AI-generated voice and text interactions.

The Service is NOT a medical device and does not diagnose, treat, cure, or prevent any medical or mental health condition
The Service is NOT a substitute for professional healthcare, mental health treatment, or crisis intervention
The Service does NOT provide emergency support or crisis intervention
Use of the Service is governed by these Terms & Conditions ("Terms") and our Privacy Policy
The Service uses artificial intelligence technology to generate responses and recommendations
All interactions are provided on an "as-is" basis and SteadySelf does not guarantee any therapeutic or health outcomes
2. ACCEPTANCE OF TERMS
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must not use the Service.
Age and Capacity:
You must be at least 18 years old (or over the age of legal majority in your jurisdiction) to independently use the Service
If you are under 18, you may only use the Service with the documented consent and ongoing supervision of a parent or legal guardian
If you are aged 14-17 and demonstrate mature minor capacity to understand the nature and consequences of use, you may consent to use following parental notification (parents retain right to withdraw consent)
For any user under 14, parental/guardian written consent is required before any use
3. SERVICE PURPOSE AND MEDICAL DISCLAIMER
3.1 Informational Use Only
The Service is provided for informational and self-care purposes only and is not intended, designed, or implied to:
Diagnose, treat, cure, or prevent any medical or mental health condition
Provide medical, psychological, psychiatric, therapeutic, or clinical advice
Monitor or assess mental health conditions
Replace professional healthcare, therapy, or psychiatric treatment
Act as a substitute for consultation with a licensed healthcare provider
Detect suicidality or imminent risk (despite any content analysis capability)
No content provided by SteadySelf should be considered medical, psychological, psychiatric, therapeutic, crisis, or emergency advice.
3.2 Not a Healthcare Provider
SteadySelf is not a licensed medical or mental health care provider. SteadySelf:
Does not employ, engage with, or contract medical or mental health professionals for Service delivery
Does not diagnose, examine, or treat medical or mental health conditions
Does not have expertise in prescribing treatments or determining treatment efficacy
Cannot and does not assess individual risk or provide personalized clinical assessment
Cannot and does not provide duty of care as a healthcare provider
3.3 AI System Operation
The Service operates using artificial intelligence technology that generates responses based on training data and algorithms. You acknowledge that:
AI systems may make errors, produce inconsistent outputs, or provide inaccurate information
AI-generated recommendations are not personalized clinical assessment
The Service cannot understand your individual circumstances, medical history, or context in the way a healthcare professional can
Responses are general informational content, not tailored to your specific situation
The Service does not "learn" your preferences or improve its recommendations for you over time in a clinically meaningful way
3.4 No Emergency or Crisis Services
SteadySelf does not provide emergency services and is not obligated to:
Detect or respond to crisis indicators in your voice or text
Contact you or anyone on your behalf in response to your stated needs
Monitor your use of the Service or assess your safety status
Escalate concerns to emergency services or crisis responders
Act as a crisis hotline or emergency support service
If you are experiencing a crisis, feel unsafe, are considering self-harm, or require immediate assistance:

You acknowledge and agree that you will not rely on SteadySelf for emergency support and that your use of the Service creates no expectation of emergency response.
3.5 Consult Healthcare Professionals
You must always consult a qualified, licensed healthcare professional regarding any:
Medical concerns or symptoms
Mental health concerns or psychological distress
Questions about mental health diagnoses, medication, or treatment
Thoughts of self-harm, suicide, or harming others
Substance use concerns
You agree that you will never:
Disregard or delay seeking professional advice because of something you experienced through the Service
Use the Service as your primary source of health or mental health information
Make health or mental health decisions based solely on Service content
Consider Service interactions as consultation with a healthcare provider
3.6 Safety Precautions for Service Use
Do not use the Service while:
Driving, operating machinery, or performing tasks requiring concentration
In an acute crisis or experiencing suicidal ideation
Under the influence of substances that impair judgment
In a state where you require immediate medical or mental health support
You are solely responsible for:
Your use of the Service and any consequences arising from that use
Ensuring your use does not interfere with essential activities
Maintaining your safety while using the Service
Seeking appropriate professional help when needed
Verifying any information obtained through the Service with qualified healthcare professionals
3.7 Assumption of Personal Risk
By using the Service, you explicitly acknowledge and assume the risk that:
The Service may not help you or may make your distress worse
The Service may provide information that conflicts with professional medical advice
The Service may be unavailable, contain errors, or function incorrectly
Your reliance on the Service instead of professional help may result in harm
AI-generated recommendations may be inappropriate or harmful for your specific situation
You may share personal or health information that could be accessed or misused
4. VOICE RECORDING AND AI INTERACTION DISCLOSURE
4.1 Voice Data Collection
When you interact with the Service voice assistant, we collect:
Audio recordings of your voice
Transcripts generated from your voice input
Your responses to voice prompts
Metadata (timestamps, session duration, device information)
You explicitly acknowledge and consent that:
All voice interactions are recorded and/or transcribed
Recordings may be retained for the periods specified in our Privacy Policy
Transcripts may be used for the purposes specified in our Privacy Policy
Separate Explicit Consent Required:
Your acceptance of these Terms grants general consent to voice collection for Service operation. However, you must provide separate explicit consent for any use of voice data beyond immediate Service delivery, including:
Use for Service improvement and development
Use for training AI models
Sharing with third-party service providers
Use in research or analytics
Aggregation into datasets
You can manage voice data consent preferences in your account settings at any time.
4.2 AI-Generated Interactions
You acknowledge that:
This Service uses artificial intelligence to generate voice responses, recommendations, and content
All voice output is generated by AI algorithms, not recorded from human speakers
The Service does not involve interaction with a human healthcare provider
AI voice may not always sound natural or may contain errors
You are interacting with an automated system, not a person
5. ACCOUNT REGISTRATION AND SECURITY
5.1 Account Requirements
You may need to create an account to access certain features. You agree to:
Provide accurate, current, and complete information
Update your information promptly if it changes
Keep your login credentials confidential
Notify us immediately of any unauthorized account access
Be responsible for all activities occurring under your account, whether authorized or not
5.2 Account Termination
We may refuse registration or terminate your account if:
You have breached these Terms
You have provided false or misleading information
We believe your use poses a safety risk to you or others
You have engaged in unlawful or abusive conduct
We are required to do so by law
5.3 Minors' Accounts
For accounts created by users under 18, we require:
Written documentation of parental/guardian consent before account creation
Parent/guardian email address linked to the account
Parent/guardian ability to access and monitor use (with appropriate privacy safeguards)
Annual recertification of consent for accounts held by users aged 14-17
Parents/guardians may revoke consent and request account deletion at any time.
6. ACCEPTABLE USE AND USER CONTENT
6.1 Acceptable Use
You may only use the Service for personal, non-commercial purposes and in accordance with these Terms and all applicable laws. You must not:
Use the Service for unlawful, harmful, abusive, or harassing purposes
Attempt to interfere with, disrupt, or damage the Service or its infrastructure
Attempt to gain unauthorized access to the Service or any related systems
Post or transmit content that infringes another person's intellectual property or privacy rights
Post or transmit personal information of a third party without their consent
Post or transmit content promoting self-harm, suicide, or harm to others
Attempt to reverse-engineer, decompile, disassemble, or copy the Service or underlying code
Use automated tools (bots, scrapers, scripts) to access or use the Service
Share your account credentials with others
Use the Service to develop competing products or services
Attempt to circumvent any technical or contractual protections
6.2 User Content and Voice Interactions
If the Service allows you to provide feedback, responses, or other content, you grant SteadySelf a non-exclusive, royalty-free, perpetual license to:
Use, reproduce, modify, adapt, and display that content
Use content for operating, testing, improving, and developing the Service
Create aggregated, de-identified datasets including your content
Use de-identified content for research and analytics
You warrant that:
You have all necessary rights to submit the content
Your content does not violate any third-party rights
Your content is accurate and not misleading
SteadySelf's use will not violate any third-party rights
You retain: the right to request deletion of your content and associated voice data (subject to legal retention requirements and data already incorporated into aggregated/de-identified datasets).
7. INTELLECTUAL PROPERTY
SteadySelf owns all intellectual property rights in the Service and all its content, including:
Voice prompts and voice-generated responses
Text content and templates
Software code and algorithms
Database compilations
Trademarks, logos, and branding
All derivative works and improvements
Your use of the Service grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal purposes only. You must not:
Copy, reproduce, distribute, or create derivative works from any part of the Service
Remove or alter any intellectual property notices, labels, or markings
License, sell, rent, or lease the Service
Use the Service to develop competing products
8. PRIVACY AND DATA PROTECTION
8.1 Privacy Policy Compliance
Your use of the Service is subject to our Privacy Policy, which is incorporated into and forms part of these Terms. You must review the Privacy Policy to understand our data handling practices.
8.2 Sensitive Personal Information
Do not share through the Service:
Full legal name (use first name only if needed)
Date of birth or age
Residential address or location information
Medicare number or health identifier
Tax File Number
Financial information (bank details, credit card numbers)
Identification document numbers
Detailed health diagnoses or medical history
Medication names or dosages
Details of psychological trauma or abuse
If you inadvertently share this information, contact us immediately at hello@steadyself.ai to request deletion.
8.3 Data Breach Notification
SteadySelf is subject to the Privacy Act 1988 (Cth) Notifiable Data Breaches (NDB) scheme. If an eligible data breach occurs that is likely to result in serious harm to you, we will:
Notify you without unreasonable delay
Provide our contact details, a description of the breach, the type of information involved, and recommendations for protective steps
Notify the Office of the Australian Information Commissioner (OAIC)

8.4 Automated Decision-Making
SteadySelf uses computer programs and artificial intelligence to:

These systems make decisions using your personal information and behaviour
You can request information about these automated decisions
You can request human review of automated decisions
You have the right to opt out of certain automated decision-making
9. INDEMNITY
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless SteadySelf and its officers, directors, employees, contractors, and agents from and against any and all:
Claims, demands, actions, damages, liabilities, losses, and expenses (including legal fees)
Arising from or related to:
Your use of the Service
Your violation of these Terms
Your violation of any applicable law
Your violation of any third-party rights
Any content you submit or generate through the Service
Any claims that your use harmed you, caused you mental health deterioration, or resulted in adverse outcomes
This indemnity does not apply to:
SteadySelf's willful misconduct or gross negligence
SteadySelf's breach of applicable law
Claims SteadySelf could have prevented through reasonable care
10. DISCLAIMER OF WARRANTIES
10.1 "As Is" Provision
The Service and all materials (including voice content, text, software, and recommendations) are provided "as is" and "as available" without any warranties of any kind, express, implied, or statutory.
SteadySelf does not warrant that:
The Service will be uninterrupted, timely, secure, or error-free
The Service will be free of harmful code, viruses, malware, or other malicious components
Voice interactions will be private or secure
Any errors in the Service will be corrected
The Service will meet your needs or expectations
Results or recommendations will be accurate, complete, suitable, or beneficial
The Service will improve your mental health or wellbeing
Information provided is medically or psychologically sound
AI-generated responses are clinically appropriate for your situation
10.2 Information Accuracy and Completeness
You acknowledge that the Service content:
May contain errors, inaccuracies, or outdated information
May not reflect current clinical guidelines or evidence-based practices
Is not peer-reviewed or professionally validated
Is provided for general informational purposes only
Should not be relied upon as a substitute for professional advice
10.3 No Implied Warranties
To the maximum extent permitted by law, SteadySelf disclaims all warranties, whether express, implied, or statutory, including:
Merchantability
Fitness for a particular purpose
Non-infringement of third-party rights
Safety or appropriateness for your circumstances
Reliability, accuracy, or completeness
No advice or information obtained from SteadySelf, whether through voice interaction, written content, or any other means, will create any warranty not expressly stated in these Terms.
11. LIMITATION OF LIABILITY
11.1 Exclusion of Certain Damages
To the fullest extent permitted by law, SteadySelf and its suppliers, service providers, and partners will NOT be liable for any:
Indirect, incidental, special, exemplary, consequential, or punitive damages
Lost profits, lost revenue, or lost business opportunity
Loss of data, files, or systems
Loss of goodwill or reputation
Business interruption or service suspension
Computer or system failure or malfunction
Physical, mental health, or psychological harm
Emotional distress, trauma, or deterioration of mental health
This applies even if SteadySelf has been advised of the possibility of such damages, and regardless of the legal theory (negligence, strict liability, breach of contract, or otherwise) upon which the claim is based.
11.2 Liability Cap
Unless prohibited by applicable law, SteadySelf's total aggregate liability to you for any and all claims arising out of or relating to these Terms, the Service, or your use of the Service, will not exceed the greater of:
AUD $50, or
The amount you paid (if any) for using the Service in the 12 months preceding the claim
This cap applies to:
All claims in aggregate
All causes of action
All theories of liability
All damages types (except as excluded below)
11.3 Exceptions to Liability Limitations
Nothing in these Terms excludes, restricts, or limits SteadySelf's liability for:
Death or personal injury caused by SteadySelf's negligence
Fraud, intentional misconduct, or willful breach
Liabilities that cannot be excluded under the Australian Consumer Law
Any liability that cannot lawfully be limited
11.4 Australian Consumer Law
To the extent Australian Consumer Law applies to you:
Nothing in these Terms is intended to exclude, restrict, or modify any rights you have as a consumer under the Australian Consumer Law
If the Australian Consumer Law applies and certain remedies cannot be excluded, our liability will be limited to the extent permitted by law, including:
Repair or replacement of the Service (at our election)
Resupply of the Service
Payment of the cost of repair, replacement, or resupply
12. ASSUMPTION OF RISK
By using the Service, you explicitly acknowledge, assume, and accept the risk that:
12.1 No Guarantees
The Service may not help you or may be ineffective
The Service may make your condition worse or increase distress
The Service may not be suitable for your specific circumstances, mental health condition, or needs
Results, outcomes, or benefits are not guaranteed in any way
12.2 Mindfulness Risks
Mindfulness practices or self-reflection may not be suitable for everyone
Some individuals with certain mental health conditions (PTSD, dissociation, psychosis, severe depression) may experience adverse effects from mindfulness
You should consult a healthcare professional before engaging in mindfulness if you have:
A history of trauma
A dissociative disorder
A psychotic disorder
Severe depression or suicidal ideation
Other mental health conditions
12.3 Personal Responsibility
You are solely responsible for your health and wellbeing
You are solely responsible for any decisions you make based on Service information
You are solely responsible for seeking professional help when needed
You are solely responsible for stopping use if the Service is unhelpful or harmful
You are solely responsible for the security of your account and information
12.4 Reliance on Information
You rely on Service information entirely at your own risk
SteadySelf is not responsible for how you interpret or apply Service content
SteadySelf is not responsible for outcomes resulting from your use of Service information
13. MODIFICATIONS TO THE SERVICE AND TERMS
13.1 Service Modifications
We reserve the right to:
Modify, enhance, or discontinue the Service (in whole or in part) at any time without notice
Change features, functionality, or content
Limit or restrict features to certain users
Suspend or terminate the Service entirely
Continued use of the Service following material modifications constitutes your acceptance of those changes.
13.2 Terms Modifications
We may amend these Terms occasionally. We will:
Post updated Terms on our website and/or within the Service
Indicate the date of the last update
Provide reasonable notice of material changes (where legally required)
Your continued use of the Service after posting updates constitutes acceptance of the revised Terms. If you do not accept revised Terms, you must stop using the Service.
14. TERMINATION AND SUSPENSION
14.1 Service Suspension
We may suspend your access to the Service immediately and without notice if we reasonably believe:
You have breached these Terms
You have engaged in unlawful or abusive conduct
Your use poses a safety risk to you or others
You have violated applicable law
We are required to do so by legal process or court order
14.2 Account Termination
We may terminate your account and delete associated data if:
You request account deletion
You have materially and repeatedly breached these Terms
We are required to do so by law
The Service is discontinued
You may stop using the Service at any time by ceasing to access it or requesting account deletion.
14.3 Survival
The following provisions will survive any termination or suspension:

15. GOVERNING LAW AND DISPUTE RESOLUTION

You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts for any disputes arising out of or relating to:

Exception: This jurisdiction clause does not apply to the extent that applicable law in your jurisdiction does not permit submission to exclusive jurisdiction.

17. MISCELLANEOUS PROVISIONS
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SteadySelf regarding the Service and supersede all prior negotiations, understandings, and agreements (whether written or oral).
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it will be severed. The remaining provisions will continue in full force and effect.
17.3 Waiver
No waiver of any provision or breach of these Terms will be effective unless in writing and signed by an authorised representative of SteadySelf. No single or partial waiver will constitute a waiver of any other provision or subsequent breach.
17.4 Assignment
You may not assign or transfer these Terms or your rights/obligations under them without SteadySelf's written consent. SteadySelf may assign these Terms and the Service to any successor (including in a merger, acquisition, or asset sale) with or without notice.
17.5 Relationship of Parties
You and SteadySelf are independent entities. These Terms do not create a partnership, joint venture, agency, or employment relationship.
17.6 Third-Party Beneficiaries
These Terms are for the benefit of you and SteadySelf only. No third party has any rights or remedies under these Terms.
17.7 Notice
Any notices required under these Terms may be provided via:

Posting on the Service or website
Physical mail to your registered address
Notices are effective upon sending (email) or posting.
18. ADDITIONAL PROTECTIONS
18.1 Accessibility
SteadySelf is committed to accessibility. If you experience difficulty accessing any features, contact us at hello@steadyself.ai to discuss accommodations.
18.2 Third-Party Services
The Service may integrate with third-party applications (health apps, calendars, etc.). We are not responsible for:
Third-party privacy practices
Third-party data handling
Third-party service interruptions
Third-party security or data breaches
Review each third party's privacy policy before granting access.
18.3 Sub-processors and Service Providers
SteadySelf uses trusted service providers for hosting, analytics, and functionality. These providers are bound by confidentiality and data protection obligations. A current list of sub-processors is available upon request at hello@steadyself.ai.
18.4 Data Retention Periods
Voice recordings: Retained for 90 days from creation (unless you download or save)
Transcripts: Retained for 90 days from creation
Account information: Retained while account is active, then 90 days after deletion
Aggregated/de-identified data: Retained indefinitely
Legal hold: Data may be retained longer if required by law or pending legal proceedings
You may request data deletion at hello@steadyself.ai (subject to legal retention requirements).
GLOSSARY OF KEY TERMS
"Automated Decision-Making (ADM)" - Use of computer programs to make or substantially assist in decisions using personal information
"Eligible Data Breach" - Unauthorized access, disclosure, or loss of personal information likely to result in serious harm
"AI System" - Artificial intelligence algorithms that generate responses and recommendations without human involvement
"Mature Minor" - A person under 18 who demonstrates sufficient maturity and understanding to consent to a particular action
"Notifiable Data Breach (NDB)" - Privacy Act scheme requiring notification of eligible breaches to OAIC and affected individuals
"Personal Information" - Information about an identified individual or one who can be reasonably identified
"Serious Harm" - Financial loss, reputational damage, physical harm, or psychological harm as assessed objectively
"Service" - SteadySelf voice-activated wellbeing assistant and all related features and content
